These Terms & Conditions (“Terms”) govern your access to and use of the Solify website(s), landing pages, and related online services (collectively, the “Site”) operated by [Solify Legal Name] doing business as Solify (“Solify,” “we,” “us,” “our”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Who we are and what these Terms cover

These Terms apply to your use of the Site and any information, content, tools, forms, calculators, chat features, and scheduling links available through the Site.

Important: These Terms do not replace or govern any separate agreement you may sign with Solify (for example, a proposal, scope of work, installation contract, financing agreement, rebate/loan documentation, or warranty documentation). If you sign a separate agreement with Solify, that agreement will control for the services it covers.

Eligibility and acceptable use

You agree that you will:

  • use the Site only for lawful purposes;
  • provide accurate information when submitting forms (e.g., contact details, address, utility information);
  • not interfere with the Site’s operation, security, or integrity (including attempting unauthorized access, scraping, or introducing malware); and
  • not use the Site to transmit unlawful, harmful, or misleading content.

We may suspend or restrict access if we reasonably believe your use violates these Terms or applicable law.

Information on the Site is general information only

The Site may include educational content about solar, net-zero upgrades, utility billing, incentives, financing, and related topics. This information is provided for general informational purposes only and is not legal, financial, engineering, or tax advice.

You should obtain professional advice appropriate to your circumstances before making decisions.

Estimates, projections, and performance assumptions

Any savings estimates, production projections, timelines, or payback references shown on the Site (or shared in preliminary conversations) are estimates only and depend on many factors, including but not limited to:

  • site conditions (roof, shading, structural constraints),
  • electrical infrastructure,
  • actual consumption and load patterns,
  • equipment selection and availability,
  • utility interconnection and net metering processes, and
  • weather variability and future changes in usage.

Final system design, pricing, and timelines (if applicable) are confirmed only through Solify’s formal proposal and/or a written agreement.

Incentives, rebates, and financing

Incentive programs, rebates, grants, and financing options are administered by third parties and can change, pause, or end without notice. Eligibility, approval, and rebate amounts depend on program rules and your circumstances.

Solify may provide guidance and administrative assistance where offered, but Solify does not guarantee:

  • that you will qualify,
  • that you will be approved,
  • the timing of approvals or payments, or
  • the final incentive amount.

Appointments, communications, and consent

When you submit your contact details through the Site, you authorize Solify to contact you about your inquiry by email, phone, and/or SMS, including for scheduling and service-related communications.

Where required by law, we will obtain appropriate consent for marketing messages and provide opt-out methods (e.g., unsubscribe links or STOP instructions). Opting out of marketing may not stop essential service communications.

User submissions (forms, files, photos, utility bills)

If you upload or submit information (including utility bills, photos, or documents), you represent that:

  • you have the right to provide it, and
  • it is accurate to the best of your knowledge.

You grant Solify permission to use that information to evaluate your request, prepare estimates/proposals, and deliver or administer requested services, subject to our Privacy Policy.

Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and disclose personal information.

Third-party websites and services

The Site may link to third-party sites (e.g., utilities, financing providers, rebate administrators, scheduling tools). Solify is not responsible for third-party content, availability, or privacy practices. Your use of third-party services is at your own risk and subject to their terms.

Intellectual property

All Site content (text, graphics, logos, images, videos, designs, and materials) is owned by Solify or used under license and is protected by applicable intellectual property laws.

You may view and use the Site for personal or internal business evaluation purposes, but you may not reproduce, distribute, modify, or commercially exploit Site content without Solify’s written permission.

Disclaimers

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Solify disclaims warranties of any kind (express, implied, or statutory), including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Solify does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by applicable law, Solify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of (or inability to use) the Site.

To the fullest extent permitted by law, Solify’s total liability for claims relating to the Site will not exceed CAD $100.

Nothing in these Terms excludes or limits liability where such limitation is not permitted by law, and nothing in these Terms affects consumer rights that cannot be waived under applicable law.

Indemnity

You agree to defend, indemnify, and hold harmless Solify and its directors, officers, employees, and contractors from claims arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party rights.

Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict of laws rules. You agree that courts located in Ontario will have jurisdiction over disputes relating to these Terms, subject to any mandatory consumer protection provisions that apply.

Consumer agreements (Ontario) – additional terms may apply

If you enter into a consumer agreement with Solify (including through the internet or at your home/business premises), additional disclosures, terms, and statutory rights (including cancellation rights in certain circumstances) may apply under Ontario consumer protection legislation. In any conflict between these Terms and a signed consumer agreement, the signed agreement and mandatory legal requirements will prevail.

Changes to the Site or these Terms

We may modify the Site or these Terms from time to time. The “Last Updated” date indicates when changes were made. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

Severability and entire agreement

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any additional terms posted on the Site, form the entire agreement regarding your use of the Site.
